PUBLIC NOTICE
NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Smithtown, Suffolk County, State of New York met at the Victor T. Liss Board Room, Patrick R. Vecchio Town Hall, 99 West Main Street, Smithtown, New York on the 23rd day of March, 2017 at 2:00 p.m., time then in effect and duly adopted proposed Local Law #2-2017 adopting amendments to Chapter 53 of the Code of the Town of Smithtown entitled "Officers and Employees", for which a public Hearing was held on March 7, 2017 and pursuant to SEQRA dated March 9, 2017 and the recommendation of the Town Attorney as follows:

Article VI Office of Deputy Superintendent of Highways
§53-26 Authority.
This article is adopted pursuant to the provisions of New York State Municipal Home Rule Law § 10, which grants to local governments the authority to enact local laws which are not inconsistent with the New York State Constitution or general laws. This article recognizes that New York State Public Officers Law § 3 was rendered a special law with respect to the residency requirements for the office of the Deputy Superintendent of Highways by the addition of § 3, Subdivision 24.
§53-27 Supersession.
This Article shall supersede § 23 of the New York State Town Law insofar as it is inconsistent with such section.
§53-28 Residency requirement.
The person holding the office of Deputy Superintendent of Highways in the Town need not be a resident or elector of the Town, provided that such person resides within the County of Suffolk.
§53-29 Effective date.
This Article shall take effect immediately.
