NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Smithtown, Suffolk County, State of New York met at the Town of Smithtown Town Hall, Patrick R. Vecchio Building, Victor T. Liss Board Room, 99 West Main Street, Smithtown, New York met on the the 3rd day of January, 2017 at 2:00 P.M.,time then in effect, and duly amended the Zoning Code and/or Map of the Town of Smithtown for Zoning Petition 2016-01 by Artis Senior Living, LLC, 1651 Old Meadow Rd., Suite 100, McLean, VA 22102 for a special exception in order to permit a 34,062 sq. ft. two story assisted living facility for property located on the north side of Jericho Turnpike, 755' east of Kings Park Rd., Commack WSI & R-10 Zoning District. SCTM#: 0800-98-3-37, and being more particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Jericho Turnpike (as widened), said point being distant the following two (2) courses from the intersection of said northerly side of Jericho Turnpike (before widening) with the easterly side of Wicks Road (Kings Park Road):
A. Distant 774.13 feet easterly as measured along the northerly side of Jericho Turnpike (before widening), thence:
B. Along a line formerly dividing Lot 37, Block 3, Section 93 & Lot 72, Block 3 Section 93 north 06 degrees 23 minutes 00 seconds east 4.83 feet to the true point and place of BEGINNING, thence;
1. North 06 degrees 23 minutes 00 seconds east, a distance of 349.25 feet to a point, thence;
2. South 87 degrees 39 minutes 30 seconds east, a distance of 296.65 feet to a point, thence;
3. South 02 degrees 36 minutes 10 seconds west, a distance of 347.96 feet to the northerly side of Jericho Turnpike, thence;
4. Along a curve to the left having a radius of 3864.50 feet, an arch length of 319.78 feet, a central angle of 04 degrees 44 minutes 28 seconds, bearing a chord of north 87 degrees 44 minutes 02 seconds west, a chord distance of 319.69 feet to the point or place of BEGINNING.
