NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Smithtown, Suffolk County, State of New York will meet at the Town of Smithtown Town Hall, Patrick R. Vecchio Building, Victor T. Liss Board Room 99 West Main Street, Smithtown, New York on the 4th day of September, 2018 at 2:00 P.M., time then in effect, to consider Zoning Petition 2018A as petitioned by the Town of Smithtown, on its own motion, for a change of zone from R-10(Residential) to NB (Neighborhood Business) on property located  at the intersection of the east side of Commack Road with the north side of Henry Street, Commack, SCTM #800-174-1-21.2. Being more particularly bounded and described as follows:

BEGINNING at the intersection of the easterly side of Commack Road (Variable Width) and the northerly side of Henry Street (50’ wide) and from said point of BEGINNING running, thence;

1.         Along the said easterly side of Commack Road, North 00 degrees 00 minutes 00 seconds East (due north), 200.00 feet to a point, thence;

2.         Along Lot 64.1. North 90 degrees 00 minutes 00 seconds east, (due East), 225.00 feet to a             point, passing over a concrete monument found at 8.4’ from the start of this course,           thence;

3.         Still along Lot 64.1 South 00 degrees 00 minutes 00 seconds West (due South), 200.00     feet to an iron pin found on the said northerly side of Henry Street, thence:

4.         Along the said Northerly side of Henry Street, South 90 degrees 00 minutes 00 seconds    West (due West), 225 feet to the point and place of BEGINNING.

Containing 45,000 square feet or 1.033 acres

            This description is written in accordance with a map entitled “Boundary and Topographic Survey, Cosentino Realty Commack 2 LLC, Henry Street, District 800, Section Map 174, Block 1, Lot 21.2, Smithtown, Suffolk County, State of New York” prepared by Control Point Associates, dated 12-18-17.

            This property is subject to easements, restrictions of record as contained on the above referenced drawings and any other documents of record, either written or implied.

AT THE AFOREMENTIONED TIME AND PLACE, a public hearing will be held and all interested persons shall be given an opportunity to be heard.
