Marriage License Requirements & Application
Marriage Licenses are issued Monday thru Friday between the hours of
9:30am - 11:30am and 1:30pm - 4:30pm
(July & August until 3:30pm)

Couples applying for a marriage license at the Smithtown Town Clerk’s office are required to appear together and must present proof of age and proof of identity by providing:
One of the following age-related documents:

      1. Birth Certificate (hospital issued certificates and copies are not acceptable)

      2. Baptismal Record, including date, place of birth, and parents’ names 
                                                  (copies are not acceptable)

      3. Naturalization Record (original document only)

AND one of the following forms of identification (expired ID is not acceptable):

      1. Driver’s License/Non-Driver’s ID

      2. Passport 

      3. Employment Photo ID

      4. Immigration Record

Applicants who were previously married must also provide proof of dissolution of all prior marriages by presenting any of the following:

      1. Judgment of Divorce Papers

      2. Death Certificates

      3. State or Court Annulments

A certified translation is required for any documents that are not in English.     Please note that notarized translations are not acceptable

The first twenty-four hours after issuance of the license is a waiting period.  The marriage license is valid for sixty (60) days after that waiting period has ended.   

$40 Fee - Cash, Check, Credit or Debit are accepted. An additional $2.00 convenience fee will be applied to all credit/debit transactions.

NoteFor those born in Puerto Rico, we cannot accept a birth certificate that was issued prior to July 1, 2010. The Puerto Rican government, the U.S. Department of State and the Department of Homeland Security collaborated on creating a new law to stop fraudulent use of documents. You can obtain further information and apply for a new birth certificate at the Puerto Rico Federal Affairs Administration.                                   

One-Day Marriage Officiant License
The NYS Domestic Relations Law was amended as of March 28, 2023.  The law now allows a person over the age of 18 to apply for a one-day marriage officiant license.  You must apply for the one-day marriage officiant license at the same Town Clerk’s Office that the couple is applying for their Marriage License.  This one-day marriage officiant license is valid only for the parties listed on the application.
